These terms and conditions (“Terms”) govern the use of services made available on or through https://constructigo.com and/or the Constructigo mobile app (collectively, the “Platform”, and together with the services made available on or through the Platform, the “Services”). These Terms also govern our privacy practices, which are outlined at https://www.constructigo.com/privacy-policy ("Privacy Policy"), as well as any guidelines, extra terms, policies, or disclaimers that we may occasionally make accessible or issue ("Supplemental Terms"). The Supplemental Terms and the Privacy Policy are essential components of these Terms. The Supplemental Terms will take precedence over these Terms if there is a discrepancy with regard to the relevant Services.
The Terms constitute a binding and enforceable legal contract between CONSTRUCTIGO-MATERIALS PRIVATE LIMITED (a company incorporated under the Company Act, 2023 with its registered address at 38, Block-F, Uttam Nagar, Delhi, 110059, India and its affiliates (“we”, “us”, or “our”), and you, a user of the Services, or any legal entity that books Pro Services (defined below) on behalf of end-users (“you” or “Customer”). You affirm and warrant that you have the requisite power and authority to agree to and be bound by these Terms by your use of the Services. If you speak on behalf of another person, you affirm and guarantee that you have the right to bind that person to these terms.
By utilizing the Services, you acknowledge and agree that you have read, comprehend, and are bound by these Terms, as they may be updated from time to time, and that you will abide by their guidelines. Any earlier written agreements with you are expressly superseded by these Terms. Please refrain from using the Services if you disagree with these Terms or do not meet the conditions outlined here.

Services

  • The offering of the Platform, which enables you to book various home-based services with independent third-party service providers ("Service Professionals"), is one of the Services. Constructigo handles the payment transfers to Service Professionals for the services they provide to you as part of the Services and collects payments on their behalf.

  • The "Pro Services" that Service Professionals provide are known as such. The Pro Services are not considered "Services" in this context. While Constructigo does offer the Pro Services, it is not liable for doing so. For the Pro Services they offer or otherwise deliver through the Platform, Service Professionals are solely liable and accountable. Service Professionals are not employees of Constructigo or its affiliates, nor are they partners, contractors, or agents of Constructigo or its affiliates. Service Professionals are not authorized to bind or speak on behalf of Constructigo.

  • Unless otherwise specified in line with the terms of a separate agreement, the Platform is solely for your personal and noncommercial use. Please be aware that the Platform is only meant to be used in India. You consent to be regarded to have accepted the Constructigo terms and conditions relevant to that legal jurisdiction if you use the Services or Pro Services from a location outside of India.
  • The Services are offered under a number of brands that Constructigo and its affiliates hold or have other rights to use.
  • The capacity of Constructigo to send you text messages, emails, or WhatsApp messages is an important aspect of the Services, including in connection with your bookings, your use of the Services, or as part of its promotional and marketing initiatives. The ability of Constructigo to offer the Services (or a portion of the Services) to you may be impacted by your decision to opt out of receiving these text messages, but you accept and acknowledge that this may happen by emailing Constructigo at info@constructigo or through the in-Platform settings.

You hereby agree to comply with any requests for identity documentation that may be made in order for you to use the Services or the Pro Services. Your inability to use the Services or Pro Services may come from your failure to abide by this request.

ACCOUNT CREATION

  • You must register for an account on the Platform in order to use the Services ("Account"). You might need to provide some information for this Account, including but not limited to your phone number. You must be at least 18 years old in order to create an account.

  • You undertake to immediately tell us of any disclosure, unauthorized use of your account, or other security breach relating to your account. You are entirely responsible for maintaining the security and confidentiality of your Account.

  • You are responsible and liable for all actions that are taken through your Account, including those taken by other parties. Any unauthorized access to your Account shall not subject Us to liability.

  • You consent to hear from us regarding (i) payment requests, (ii) general information about us and the Services, (iii) special deals and services from us and our third-party partners, and (iv) any other issues pertaining to the Services.

USER CONTENT

  • Our platform may include interactive tools or services that let users submit comments, reviews, suggestions, feedback, ideas, or other materials on or through the platform ("User Content"). These users must have registered for an account with us.We may ask you for evaluations of Service Professionals as part of the efficient delivery of the Services and for quality assurance purposes, and you agree and accept that Service Professionals may give us reviews of you. You are not allowed to purposefully give erroneous, fraudulent, or misleading information about the reviews. We will utilize reviews to evaluate the quality of the Platform and to decide if Customers and Service Professionals are appropriate users. We reserve the right to terminate your registration and remove you from our Platform if we decide, in our sole discretion, that you are not an appropriate user.
  • You hereby grant us a non-exclusive, worldwide, perpetual, irrevocable, transferable, sublicensable, and royalty-free license to: (i) use, publish, display, store, transfer, process, communicate, distribute, and make available User Content for the operation of, and in connection with, the Services; and (ii) use User Content for the specific purposes of advertising and promoting the Services, or for the limited purpose of providing evidence.
  • You hereby release and discharge us from any and all claims based on any moral rights or other similar rights relating to the User Content in connection with these Terms and the licenses granted under this section.
  • You accept and understand that Constructigo has the right to remove or otherwise restrict access to any User Content that it determines to be in violation of these Terms without providing you with prior notice.

Terms related to cancellation and refunds are typically included in the policy. Construction material suppliers define conditions under which orders can be cancelled and the refund process. On-demand service providers outline cancellation windows and the corresponding refund or credit procedures.

Dispute Resolution

In case of conflicts, the policy often outlines dispute resolution mechanisms. These might involve negotiation, mediation, or arbitration, aiming to resolve issues amicably and efficiently.
